Appeals Court reverses judge's decision to remove 4 Warren council members from primary ballot

WARREN, Mich. (WXYZ) — A Michigan Appeals Court has reversed a judge's decision to remove four Warren City Council members from the August primary ballot after a lawsuit was filed challenging their term limits.

In two rulings released Thursday, the Appeals Court, it states that the plaintiff, Connor Berdy, who is also a candidate for Warren City Council, sued the defendants in an attempt to bar the candidates, arguing that they were "term-limited under and of the Warren City Council."

Council President Cecil St. Pierre, Council Vice President Steven Warner, Council Secretary Robert Boccomino and at-large Councilman Scott Stevens were initially expected to be removed from the list of names eligible to run in the 2019 election after a ruling by Macomb County Circuit Court Judge James Maceroni.

This ruling was made in May.

The defendants appealed the decision, saying that the trial court ignored a prior circuit court decision from 2015.
