Livingston County Judge Theresa Brennan and her attorney came to court with motions to limit the evidence to come in against her and to get the process stopped, calling it Unconstitutional.
But the Judge/Master presiding over this, retired Wayne County Circuit Judge William Giovan, denied the motions and said any recommendation he makes is not final.
“The Supreme Court doesn’t always agree with the recommendations of the Judicial Tenure Commission,” Giovan said.
Judge Brennan is facing several misconduct allegations including failure to disclose and to disqualify herself because of a personal relationship with a Michigan State Police Detective in a murder case held in her courtroom.
Jerome Kowalski is doing life in prison after that trial.
His son, Jared was in court for the hearing today and said, “I’m excited cause it’s the first time there’s something positive happening with this case regarding Judge Brennan that ultimately affects my father’s case.”
The full hearing is set to proceed on Oct. 1. It will be heard inside a courtroom in 16th District Court in Livonia.
